Terms & Conditions apply to the legal relationships arising from ordering via the ordering environment (hereinafter referred to as E-shop) of books and other products (hereinafter referred to as Product or Products) on the homepage www.libplanet.com of Lib OÜ (Reg. Code 12450790, official address Peterburi tee 16-54 , Tallinn 11411) (hereinafter referred to as LibPlanet).

In addition to these Terms & Conditions, the legal relationships between the Client and LibPlanet are regulated by the effective laws of Estonia, the E-shop price list, and established good practices.

1.Procedure of ordering products

1.1. To order a Product, the Client does not have to sign up as a user of the LibPlanet internet environment (hereinafter referred to as Internet Environment).

1.2. The Client chooses the desired Product(s), determines the quantity of each Product, the method of payment for and delivery of Products, and confirms the order.

1.3. Price for the delivery of Products pursuant to the delivery method chosen by the Client is added to the price of ordered Products.

1.4. The order becomes effective upon dispatch of the Product by LibPlanet to the Client. LibPlanet shall notify the Client by e-mail on the dispatch of Products and on the entry into force of the order deriving therefrom.

2.Delivery of Products

2.1. LibPlanet shall deliver the ordered Products to the Client according to the method chosen by the Client upon submission of the order: via Omniva Eesti (Post 24) parcel terminal, SmartPOST parcel terminal, to a post office of Omniva Eesti or by courier.

2.2. The Client chooses the delivery method upon completing of the order. The prices for delivery are provided in the price list, which is visible to the Client upon completing of the order.

2.3. The delivery times provided in the E-shop apply only to delivery within the Republic of Estonia. For delivery to a foreign country, please see paragraph 2.5.1.

2.4. Delivery methods of Products

2.4.1. Omniva Eesti (Post 24) delivers the Product(s) to the Client chosen parcel terminal within Estonia on the following work day, if the order has been completed on a work day before 15:00 and the order includes only books located in Estonia. When ordering books only located in Estonia after 15:00, the order will arrive at the parcel terminal on a work day after the following work day. In the case of other conditions, the delivery time of the order is up to 4 work days (except if the parcel contains books ordered from abroad or the parcel is being ordered to abroad). Upon arrival of the order in the parcel terminal, a message is sent to the Client’s mobile phone and e-mail address that includes the location of the parcel terminal, business hours, and personal locker code. Upon entering the code on the screen of the parcel terminal, paying for the order by card, if necessary, the locker door opens and the Client receives the parcel. Deliveries are stored for free in the parcel terminal for 7 calendar days as from the sending of the message to the Client’s mobile phone and e-mail address. After the 7 day period has expired, Omniva Eesti (Post 24) shall return the parcel to Sender. Libplanet contacts the Client again in relation to the receipt of the parcel and an individual agreement shall be made on the account of the execution of the order. If an agreement cannot be made with the Client or the Client cannot be contacted, the order shall be subject to cancellation, LibPlanet shall deduct a 4 € handling fee from the sum of the order and the surplus of the sum paid for the order shall be returned to the Client’s bank account.

2.4.2. SmartPOST delivers the Product(s) to the Client chosen parcel terminal within Estonia on the following work day, if the order has been completed on a work day before 15:00 and the order includes only books located in Estonia. When ordering books only located in Estonia after 15:00, the order will arrive at the parcel terminal on a work day after the following work day. In the case of other conditions, the delivery time of the order is up to 4 work days, except if the parcel contains books ordered from abroad or the parcel is being ordered to abroad. Upon arrival of the order in the parcel terminal, a message is sent to the Client’s mobile phone and E-mail address that includes the location of the parcel terminal, business hours, and personal locker code. Upon entering the code on the screen of the parcel terminal, paying for the order by card, if necessary, the locker door opens and the Client receives the parcel. Deliveries are stored for free in the parcel terminal for 7 calendar days as from the sending of the message to the Clients mobile phone and/or e-mail address. Additional 2 reminder messages shall be sent to the Client about undispensed parcels. If Client has not gotten the parcel within 7 calendar days, the order shall be subject to cancellation, LibPlanet shall deduct a 4 € handling fee from the sum of the order and the surplus of the sum paid for the order shall be reimbursed to the Client’s bank account.

2.4.3. The parcel shall arrive at an Omniva Eesti post office within Estonia on the following work day, if the order has been completed on a work day before 15:00 and the order includes only books located in Estonia. When ordering books only located in Estonia after 15:00, the order will arrive at the parcel terminal on the work day after the following work day. In the case of other conditions, the delivery time of the order is up to 7 work days, except if the parcel contains books ordered from abroad or the parcel is being ordered to abroad. Upon arrival of the order in the post office, a message is sent to the Client’s mobile phone that includes the location of the post office and business hours. The parcel is stored in the post office for 15 calendar days. After the elapse of that period, Omniva Eesti shall return the parcel to its sender. If Client had not visited the post office to receive the parcel within 15 calendar days or asked for it to be stored longer, the order shall be subject to cancellation, LibPlanet shall deduct a 4 € handling fee from the sum of the order and the surplus of the sum paid for the order shall be reimbursed to the Client’s bank account.

2.4.4. Omniva Eesti courier shall deliver the parcel on the following work day to the address provided by you. You shall be contacted before delivery to agree on a suitable time for delivery. If delivery of the parcel cannot be made at the time agreed upon, you shall be contacted by phone. If the courier cannot contact you by phone, a notice shall be left in your mailbox and you shall receive the order from the nearest post office. To prevent this, enter your phone number in the user settings for the courier to be able to agree with you beforehand on the delivery time of the parcel. If you have not visited the post office to receive the parcel within 15 calendar days or asked for it to be stored longer, the order shall be subject to cancellation, LibPlanet shall deduct a 4 € handling fee from the sum of the order and the surplus of the sum paid for the order shall be reimbursed to the Client’s bank account.

2.5. Ordering and Delivery outside the Republic of Estonia

2.5.1. LibPlanet offers the option to order books to outside the Republic of Estonia. To order to abroad, add the desired products to the chart, choose the delivery method, enter the address and choose a destination from the list of countries. The execution of the order could take 7–30 work days, depending on the country.

2.5.2. The prices for delivery of an order outside the Republic of Estonia are provided in the price list, which is visible to the Client upon completing of Order.

2.5.3. If LibPlanet is not able to deliver the order to the Client due to reasons arising from the Client, the order shall be subject to cancellation, LibPlanet shall deduct expenses related to returning the Order from the sum of the order and the surplus of the sum paid for the order shall be returned to the Client’s bank account.

3.Consumer’s right to withdraw from order

3.1. A Client who is a consumer (hereinafter referred to as Consumer) has the right to withdraw from the order of Products as from making the order to 14 calendar days following the receipt of Products.

3.2. To withdraw from the order, the Consumer shall submit to LibPlanet an application in writing or by e-mail.

3.3. The written application to withdraw from the order shall include the number and owner of the bank account where the reimbursed money shall be transferred. LibPlanet does not make reimbursements in cash.

3.4. If the Consumer withdraws from the order, the Consumer undertakes to return the unused and undamaged Products immediately, but not later than within 30 calendar days as of the sending out of application to withdraw.

3.5. LibPlanet shall reimburse to the Consumer the sum paid for the returned Products (except for delivery expenses) within 30 calendar days at the latest as from receipt of the application to withdraw on the condition that the Client has also returned the Products by that time. LibPlanet shall also reimburse delivery expenses to the Consumer, if the cause for withdrawal is a faulty Product.

3.6. If the Product returned by the Client has been used, LibPlanet has the right to claim compensation for damage in a sum of up to the Product’s sale price depending on the decrease of the value of the Product. The cited sum shall bededucted from the sum reimbursed to the Client.

3.7. Digital products (including e-books) cannot be returned.

4. Registration procedure

4.1. To become a registered client of LibPlanet, the Client must sign oneself up as an Internet environment user at the address www.libplanet.com. The Internet environment can also be logged in by a Facebook account.

4.2. By signing up as a registered client, the Client has the right to get henceforth the benefits established for registered clients, pursuant to the LibPlanet registered clients’ programme.

4.3. To sign up, it is necessary to fill in all gaps in the form.

4.4. After singing up, LibPlanet shall send an e-mail with activation instructions to user account’s e-mail address specified by the Client.

4.5. After activation of the user account, the Client can enter the Internet environment of LibPlanet with its own username and submit orders for Products.

5. Rights of Client

5.1. The Client has the right to order Products for the price and according to conditions provided in the E-shop by LibPlanet.

5.2. The Product delivered to the Client must be correct and complete and meet the conditions set out by LibPlanet.

5.3. The Client has the right to file complaints related to the order of a Product or the Product itself to LibPlanet at the address Peterburi tee 16-54, Tallinn or at the e-mail address info(at)libplanet.com within 30 calendar days as of receipt of the Product.

5.4. The Client has the right to withdraw from the order of Products pursuant to clause 3.

6. Obligations of Client

6.1. Upon completing of an order, the Client is obliged to submit data necessary for the execution of the order: forename and surname, exact address (street, house No., flat No., postcode, town/settlement/ or village/county), contact phone, and e-mail address, if possible.

6.2. If the Client and receiver of the Product are different, the Client shall submit the data specified in clause 6.1 also about the receiver.

6.3. If the data submitted by the Client is faulty and/or incomplete and does not conform to the provisions of clause 6.1, LibPlanet does not guarantee the proper execution of the order. If possible, LibPlanet will contact the Client to specify the faulty or incomplete data.

6.4. Upon completing of an order, the Client confirms agreeing with the terms and conditions provided in these Terms & Conditions and undertakes to follow them.

7. Rights of LibPlanet

7.1. LibPlanet has the right to amend these Terms & Conditions without prior notification by publishing new valid conditions in the Internet environment.

7.2. LibPlanet has the right to amend the E-shop price list any time without prior notification by publishing the new price list in the Internet environment.

7.3. LibPlanet has the right to waive from accepting an order, including, but not only in the case when a wrong price has been mistakenly published in the price list.

7.4. LibPlanet does not ensure that the content of the book prepared by the publisher of the book corresponds to the Client’s opinion about the content of the book.

7.5. If the Client does not fulfil its obligations under these Terms & Conditions, LibPlanet shall not guarantee the enforcement of the order and/or the proper delivery of the Product.

7.6. If the Client does not fulfil properly the payment obligation, LibPlanet has the right to publish the Client’s data in the Estonian Credit Register.

8. Obligations of LibPlanet

8.1. LibPlanet undertakes to deliver to the Client correct and complete Product(s).

8.2. LibPlanet undertakes to accept and document all complaints of a Client.

8.3. LibPlanet undertakes to solve a Client’s complaint within 7 work days, if the causes of the complaint are independent from the Client. If the cause of the complaint is caused by the Client, the Client shall eliminate it immediately.

8.4. LibPlanet undertakes to replace damaged items of Products. LibPlanet shall be liable only for manufacturing defects and other deficiencies that existed upon delivery of the Product to the Client.
